Big Lawsuits Not Going Away Soon, Study Finds






Settlements in “collective
action” lawsuits—which are similar to class action suits—brought under the federal
Fair Labor Standards Act (FLSA) during 2006 “outpaced employment discrimination
class action settlements in terms of overall settlement values,” according to a
new report prepared by national law firm Seyfarth Shaw, which has several California offices. What’s
more, the number of FLSA collective suits filed in 2006 increased over 2005 and
“far outpaced employment discrimination class action filings.” The firm’s third
Annual Workplace Class Action Litigation report, which is based on an analysis
of 407 workplace- related class action rulings issued in 2006 by both state and
federal courts, concludes that the trend toward “big impact FLSA collective
actions,” such as those filed in 2006 by financial services employees, is expected
to continue in 2007.
